Terms of Service
Effective date: 19 September 2026
Back to app →1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your use of SwiftBuilder (the “Service”), operated by BLIT Solutions (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or client, you confirm that you have authority to bind them to these Terms.
2. Definitions
- Service — the SwiftBuilder website builder, including the editor, hosting of your working content, and the export/deployment features.
- Content — anything you create, upload or store in the Service: projects, pages, blog posts, text, images, and site settings.
- Client Site — a website you build with the Service and publish or export.
- Your Hosting — the hosting account or server you configure to receive an exported site.
3. Eligibility & Accounts
You must be old enough to enter into a binding contract in your jurisdiction, and you must provide accurate registration details. You are responsible for keeping your password confidential and for everything that happens under your account.
You must verify your email address before you can sign in. Please keep your credentials confidential and use any additional security features we make available to you.
4. The Service
The Service lets you build websites visually and publish them. You can keep a site hosted with us, or export it as a static website and deploy it to your own hosting account.
We may add, change or remove features over time. We aim to give reasonable notice of changes that materially affect how you use the Service.
5. Plans, Fees & Billing
The Service is currently offered without charge. If we introduce paid plans, we will publish the pricing and terms before any charge applies, and you will be able to choose whether to continue.
6. Your Content
You keep all rights to your Content. To operate the Service we need a limited licence to host, store, copy, transmit and display your Content — for example, to render your site, create backups, and deploy an export to the hosting you choose. That licence lasts only as long as needed to provide the Service, and ends when you delete the Content or your account (subject to our backup retention window).
You are responsible for your Content: you must have the rights to use it, and it must not infringe anyone else’s rights or break the law.
7. Publishing, Deployment & Your Hosting
When you publish a Client Site, it becomes publicly accessible. Do not publish anything you are not willing to make public.
If you use the deployment feature, you provide connection details for Your Hosting (for example, an FTP/FTPS account). By doing so you confirm that you are authorised to deploy to that account. We protect those credentials, use them only to carry out the deployment you initiate, and never display them back to you in full.
Deploying overwrites files at the destination you choose. You are responsible for choosing the correct destination and for keeping your own backups of anything already there. We do not control Your Hosting and are not responsible for its availability, security or configuration.
8. Acceptable Use
You must not use the Service to:
- Publish or distribute anything unlawful, defamatory, hateful, or infringing.
- Create phishing, scam, malware or deceptive pages, or impersonate another person or organisation.
- Send unsolicited bulk email, or collect personal data unlawfully.
- Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure.
- Interfere with, overload, or probe the Service other than as permitted by us.
- Deploy to a hosting account you do not have permission to use.
Because published sites are public, we may remove or disable content that breaches these Terms, and may suspend accounts that repeatedly or seriously breach them.
9. Third-Party Services
The Service relies on third-party providers (for example, hosting and transactional email) and lets you connect to third-party hosting. Their terms and privacy practices apply to your use of them, and we are not responsible for third-party services we do not control.
10. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
11. Intellectual Property
The Service itself — its software, design and content, excluding your Content — belongs to us and our licensors. These Terms do not grant you any rights in our trademarks, branding or software beyond what is needed to use the Service.
If you send us feedback or suggestions, we may use them without restriction or obligation to you.
12. Suspension & Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, if we are required to by law, or if your use poses a risk to the Service or other users.
Where practical, we will give notice and a chance to export your Content. After termination we may delete your Content, subject to our backup retention window and any legal requirement to keep records.
13. Disclaimers of Warranties
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, availability, and freedom from errors. We do not warrant that the Service will be uninterrupted, that published sites will be available at all times, or that any deployment will succeed.
14. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, data, goodwill or business, arising from your use of the Service. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the Service in the twelve months before the claim (or, if you have paid nothing, a nominal amount).
Nothing in these Terms limits liability that cannot lawfully be limited.
15. Indemnification
You agree to indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your Content, your Client Sites, your use of Your Hosting, or your breach of these Terms.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. The courts of the Republic of Kenya have exclusive jurisdiction over any dispute, unless a mandatory consumer-protection rule in your country of residence says otherwise.
Before starting formal proceedings, we ask that you contact us so we can try to resolve the issue directly.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. If the change is material, we will take reasonable steps to notify you — for example, by email or a notice in the Service. Continuing to use the Service after a change means you accept the updated Terms.
18. General Provisions
If any part of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation or sale. These Terms, together with the Privacy Policy, are the entire agreement between us about the Service.
